February 3, 2017, in a coordinated effort, Ambassador Alberto Szekely and Licenciado John Moreno, filed a Denuncia Populare or Citizen’s Complaint against Grupo Mira/Tres Santos in the Procuraduria Federal de Protección al Ambiente PROFEPA in Mexico City D.F and in La Paz, Baja California Sur, for environmental damage at Punta Lobos beach in Todos Santos resulting from the Project known as Tres Santos and for failure to enforce the Urban Development Plan (PDU Programa Subregional de Desarrollo Urbano) for Todos Santos, El Pescadero and Las Playitas.

March 1, 2017,  The Moreno family was warned that a small team within the office of the Procurador are combing files to make a list of all cases involving John Moreno.

March 6, 2017,  John’s team receives a call from the counter part in a lawsuit that John is handling, they tell us that they had received an offer from someone identified as being from the Procuraduria, offering to help them in their case if they will denounce John. They are offered legal and “other kinds of help” that will lead to a favorable outcome in their case. They are invited to a meeting at the office of Tres Santos on March 8th with the Procurador and some attorneys.

March 8, 2017, at 5 pm, a convoy of three white suburbans including the Procurado del Estado goes to Hotel San Cristobal at Punta Lobos beach. The meeting is hosted Javier Barrios, President of MIRA/Tres Santos. A “dossier” of complaints against John Moreno and the Moreno family is passed out to all. (see attached) The Procurador offers his support and tells those present how to proceed. The Tres Santos attorneys arrange to meet with those willing to participate in the “reconstruction” of their cases to result in the incarceration of John Moreno.

Enrique Chávez Ugarte, agrees to collaborate with the plan to frame John. In 2014 John represented Joella Corado in a law suit to recover property that had been invaded by Chávez. They won the case. Now in March 2017, Chávez begins to meet with attorneys provided by Tres Santos and the case is reopened.

March 13, 2017, John does an interview with Ricardo Madrazo of Baja Sur TV exposing the plan and tells Ricardo that if he is arrested to publish the interview on the internet. Link to video by Baja Sur TV.

April 5th, 2017, A case is developed by the Ministerio Público in Pescadero and sent to the judge for evaluation. This video is not subtitled in English.

May 15, 2017, Javier Barrios meets with Governor Carlos Mendoza. Photos on local press showed them touring some of the Tres Santos locations; Hotel San Cristobal & Jazamango.

May 19th: John and Joella Corado are arrested for a “grave” crime and not allowed bail.

Ricardo Madrazo of Baja Sur TV, uploads a video to facebook updating the community of the arrest of John Moreno and Joella Corado. The details were unclear at the time. However, later we found out that it was in regard to a property case that he fought and won for Joella Corado in 2014, against Enrigue Chavez. The authorities were able to make this arrest due to documents that were falsified and submitted to 2 different courts. The first judge refused it and later after re-submitted their documents, were able to get the second judge to make the order. Another video of the case and visuals of the falsified documents.

It is important to note: While John Moreno is incarcerated, many of his lawsuits in regard to Tres Santos were having their day in court. His team worked tirelessly on making sure everything was still moving while he was away. Below please note the dates of the rulings they started coming 2 weeks after his arrest.

La Paz, May 19, 2017 – Peaceful demonstration held outside of the prison where John and Joella have now been detained for a little over a month. People gathered to speak out in protest of these political prisoners and pleaded for their freedom. There was music, dancing, and love.

May 29, 2017 – Popular complaint to PROFEPA for transiting: Judge orders to fulfill the obligation to carry out a thorough investigation, take into account the evidence provided by the complainant and follow the appropriate processes. – For the Office of Revision Resource No .: RR / 00706 / BCS / 2016, the Legal Sub-Attorney of the Federal Attorney for Environmental Protection. May 29, 2017 – Lic. John Moreno is notified of PROFEPA case PFPA / 10/1 / 26.28.2 / 692/2017. They close the case and conclude that there are no items (only 15 days for review).

June 23, 2017 – Jesus Cota, Ricardo Madrazo, Jamie Sechrist and Lisa F. Jackson receive Amparos re: Denunciation Tres Santos of dispossession.

July 6, 2017 – PROFEPA case PFPA / 10/1 / 26.28.2 / 692/2017. Denunciation of nullity for the false determination of the non-existence of the facts denounced, without motivation or any legal basis.

Meanwhile in Colorado, July 8, 2017, Run for Freedom. This run started at CSU at the Lory Student center and ended 40 some miles away at the state capital in Denver. Indiginous Youth Council member Mica Ironshell coordinated this race with her family and friends to make a stand against the illegal detention of John Moreno and Joella Corado.

July 12, 2017 – ITAIBCS – Decision decision in favor of Lic. John Moreno documents, permits, plans, etc. Ortogado to Tres Santos by the Town Hall.

Review Procedure against General Direction of Urban Development and Ecology of H.XV Ayuntamiento de La Paz for documents, permits, various plans related to the real estate tourist called Tres Santos and / or Playa Santos and FRBC Todos Santos Dos, S de R.L. Of C.V. Original request April 13, 2016. After several non conformity by the City Council is resolved in favor of Mr. John Moreno July 12, 2017.

On August 20, 2017, the Punta Lobos Coop, friends, family and community members gathered at Playa Punta Lobos for a group photo. This photo was to reiterate their undying support and demands for releasing John and Joella from jail. The next day they were to have their release hearing held. Hopes were high that they would finally be released.

August 21, 2017, was a special day. Not just because of the solar eclipse, but also it was the day that John and Joella were to be heard in regard to their release. After 6.5 hours of waiting for the verdict, we got word that Lic. John Moreno was to be released from jail. Right after his case was heard, it was Joella’s turn. She too was released on bail and could return home with her family and friends. They still have to face the charges but they can do so as free people.
